Terms of Service
These Terms of Service ("Terms") are an agreement between you and Cosine Technology (Wuhan) Co., Ltd. ("we", "us", "our"), a company registered in the People's Republic of China. They apply to the mini games we publish on TikTok (the "Games") and to our website, cosinegames.com.
By opening or playing a Game, you agree to these Terms and to our Privacy Policy (https://cosinegames.com/privacy/). If you do not agree, please do not play the Games.
The Games run inside the TikTok app, so TikTok's own terms and policies also apply to your use of TikTok. If these Terms conflict with TikTok's terms on matters that TikTok controls (such as your TikTok account, payments, and ads), TikTok's terms apply to those matters.
1. Who can play
You must meet the minimum age required to use TikTok in your country. If you are under the age of majority where you live, you may play only with the permission of a parent or guardian, who agrees to these Terms on your behalf and is responsible for your purchases.
2. Your license to play
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to play the Games for your own non-commercial entertainment, in accordance with these Terms. We and our licensors own all rights in the Games, including their code, graphics, characters, music, text and trademarks. Except for this license, no rights are transferred to you.
3. Virtual items and purchases
- The Games may offer virtual items, such as power-ups, skins, or extra lives, which you can earn by playing, receive by watching ads, or buy.
- Purchases are processed by TikTok using TikTok's payment system and are governed by TikTok's payment terms. We do not receive your payment card details.
- Virtual items have no monetary value and cannot be exchanged for real money, goods, or anything of value outside the Game. You may not sell, transfer, or trade virtual items or game progress, whether inside or outside the Game, except through features we provide for that purpose.
- What you get from a purchase is a license to use the virtual item in the Game. It is not ownership of property.
- Refunds are handled under TikTok's refund policy. Except as required by applicable law, purchases are final. Nothing in these Terms limits any right to a refund or withdrawal that you have under mandatory consumer protection law in your country.
- If you did not receive an item you paid for, contact us at support@cosinegames.com with your order number, and we will investigate and deliver the item or help you obtain a refund.
4. Ads
The Games may show ads served by TikTok, including optional rewarded video ads. If you choose to watch a rewarded ad to the end, we will give you the stated reward. Rewards may not be granted if an ad fails to load or play, or if you close it early. We are not responsible for the content of third-party ads or for any products or services they promote.
5. Rules of conduct
When using the Games, you agree not to:
- use cheats, bots, scripts, automation, exploits, or any unauthorized software to gain an advantage;
- copy, modify, decompile, reverse engineer, or create derivative works of the Games, except as allowed by law;
- interfere with the Games, our servers, or other players' enjoyment;
- abuse bugs or errors; if you find one, please report it to us;
- use offensive, hateful, or unlawful names or content where the Games allow you to enter text;
- impersonate others or break any applicable law; or
- use the Games for any commercial purpose without our written permission.
If you break these rules, we may, to the extent permitted by law, remove the virtual items or progress obtained improperly, reset your data, or suspend or end your access to the Games.
6. Changes to the Games
We are always working to improve the Games. We may add, change, or remove features, content, or virtual items, and we may stop operating a Game. If we decide to permanently stop operating a Game in which you can make purchases, we will give at least 30 days' notice in the Game or on our website, stop selling virtual items when we give that notice, and offer any refund required by applicable law.
7. Disclaimers
The Games are provided for entertainment "as is" and "as available". To the extent permitted by law, we make no warranties, express or implied, that the Games will be uninterrupted, error-free, or free of harmful components, or that data or progress will never be lost. Your use of the Games also depends on TikTok, your device, and your network connection, which we do not control. Some countries do not allow certain warranties to be excluded; in those countries, the exclusions above apply only as far as the law allows.
8. Limitation of liability
To the extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to the Games. To the extent permitted by law, our total liability to you for all claims relating to the Games is limited to the greater of (a) the amount you paid for purchases in the Games in the 12 months before the claim arose, or (b) USD 50.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for death or personal injury caused by negligence, for fraud, or for intentional or grossly negligent conduct, or any right you have as a consumer under the mandatory law of your country.
9. Ending these Terms
You can stop using the Games at any time. We may suspend or end your access to the Games if you seriously or repeatedly break these Terms, if we are required to do so by law, or if we stop operating the Games. Sections 2 (ownership), 3 (the nature of virtual items), 7, 8, 10 and 11 continue to apply after these Terms end.
10. Governing law and disputes
These Terms are governed by the laws of the People's Republic of China, excluding its conflict-of-law rules. If a dispute arises, please contact us first at support@cosinegames.com; we will try to resolve it informally. If it cannot be resolved within 60 days, either party may bring it before the people's court with jurisdiction over our registered address.
If you are a consumer, this section does not deprive you of the protection of the mandatory laws of the country where you live, or of your right to bring a claim in the courts of that country where the law allows it.
11. General
- Changes to these Terms. We may update these Terms. We will post the new version on our website and update the "Last updated" date. If the changes are significant, we will give you reasonable notice in the Game or on our website before they take effect. If you keep playing after the changes take effect, you accept the updated Terms.
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Games.
- Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
- No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
- Assignment. We may transfer our rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets, provided your rights are not reduced. You may not transfer yours.
- Language. If these Terms are translated, the English version prevails, unless the law of your country requires otherwise.
